Ontario's Progressive Conservative government has launched public consultations on amending our motor vehicle insurance laws. The issues if you are an insurer are fraudulent claims and if you are a consumer or accident victim, ever increasing premiums and converse attrition of accident benefits and tort award entitlement. The OSPCA case: Property rights and fundamental justice | Heather MacIvor
On Jan. 2 the Ontario Superior Court struck down three sections of the Ontario Society for the Prevention of Cruelty to Animals Act (OSPCA Act). In Bogaerts v. Attorney General of Ontario 2019 ONSC 41, Justice Timothy Minnema found that the impugned provisions infringed s. 7 of the Charter. He further concluded, without hearing submissions on this issue, that the Attorney General of Ontario could not justify the infringements under s. 1 of the Charter. He suspended the declaration of invalidity for 12 months. Read more

Charities need to tread carefully through new political activity rules | By Daniel Frajman
Imagine a situation where you are consulted by a charitable organization, or even a charitable foundation, that is working to find a cure for a particular genetic disease. That charity now asks you to submit on its behalf a request to the Canada Revenue Agency for permission to carry out additional research to support a change to provincial health care rules so that new experimental medical care for that disease would be covered by provincial health care plans.
